In June 2015, Ferriter Scobbo attorneys Michael Vhay and Valerie Moore filed a complaint with the US Department of Housing and Urban Development against the City of Newton, MA on behalf of two developers of affordable housing.   The complaint recounts the City’s violations of the federal Civil Rights Act and the federal Fair Housing Act, including the City’s false certifications that it is affirmatively furthering fair housing. The complaint charges that the City has illegally blocked privately sponsored affordable housing projects proposed under the Massachusetts’ comprehensive permit law, chapter 40B, and has failed to amend its zoning ordinance to facilitate construction of diverse, multifamily housing.  HUD reports that the complaint is under investigation.
