    Congratulations to Ferriter Scobbo’sclient, the Massachusetts Municipal Wholesale Electric Company (“MMWEC”) and MMWEC’s member, the West Boylston Municipal Light Plant (“WBMLP”) for closing on an over $4.6 million fixed-rate, 15-year loan. Ferriter Scobbo represented MMWEC in the transactions, including the Loan Agreement with Bank of America, the proceeds of which funded a  loan from MMWEC to WBMLP through MMWEC’s Pooled Loan Program.  Ferriter Scobbo drafted the supplemental resolution to MMWEC’s Pooled Loan Program Resolution to authorize the transaction.

    Ferriter Scobbo attorneys Michael Vhay and Valerie Moore represented the Woods Hole, Martha’s Vineyard and Nantucket Steamship Authority in a recent hearing on objections to the Authority’s plans to rebuild its Woods Hole ferry terminal. The multimillion dollar project includes reconstructing and realigning the three boat slips at the ferry terminal, demolishing the existing terminal and excavating a large portion of the existing wharf.

    Attorneys Michael Vhay and Valerie Moore attended the grand opening of The Roxbury Latin School’s Indoor Athletic Facility (IAF) on Friday, January 20. Vhay and Moore were recognized for their work with Roxbury Latin’s development team. The IAF ran into trouble when some of the school’s neighbors appealed the project’s permits to the Boston Zoning Board of Appeals (ZBA). Vhay and Moore proved to the ZBA that the IAF fit within the Boston Zoning Code’s definition of an educational use, one allowed in the School’s zoning district.

    Ferriter Scobbo & Rodophele, PC represented, the Wakefield Municipal Cooperative Corporation (“Cooperative”), in closing on an Amended & Restated Financing & Security Agreement (“Financing Agreement”) with Wells Fargo Bank, N.A. The Financing Agreement provided for the Cooperative to issue a tax exempt refunding bond in the principal amount of $6,280,000.00. The proceeds of the refunding bond were used to pay off an outstanding indebtedness and change the debt from a floating to a fixed interest rate.

    A recent decision of the Massachusetts Appeals Court makes it clear that insurance agencies may be held responsible when their employees access, for unauthorized purposes, the personal information of not just insureds, but also of claimants.
