I am a founding shareholder of Ferriter Scobbo. For most of the approximately four decades I’ve been in practice, I’ve focused on helping my clients solve their complex legal problems in the Boardroom, Courtroom and Statehouse. Experience in the Courtroom informs my advice in the Boardroom, while knowledge of both the Boardroom and Courtroom informs my work in the Statehouse.

My approach to problem solving is strategic and thematic with an absolute focus on my clients’ goals and objectives. Not only do I apply my legal experience to solve the problem, but also, I utilize my educational background and prior work experience in accounting, finance, statistics and economics.   I represent a wide range of public as well as private entities in the boardroom and the courtroom. 

In the Boardroom

I assist my clients on finance, corporate governance, advice and policies, employment issues, environmental issues, contract formulation and review, construction, permitting, strategic planning and litigation strategies. The energy industry is a major focus of my practice.  I have many years of experience in complex regulatory, financing, corporate structure, permitting, construction and operational issues associated with nuclear, oil, coal, natural gas, wind and solar electric generation, including transmission and distribution. I have represented clients in pipeline project development, siting, permitting, contracting and financing. I have drafted and negotiated oil and natural gas purchase and sale contracts, as well as electric power contracts, and their financing for producers, wholesalers and end-users. I have drafted and negotiated transportation and transmission contracts and numerous hedging arrangements. I have advised boards of directors, CEOs, commissions and managers.  I’ve represented clients in the structure, development, contracting, permitting, financing and operation of renewable energy projects including, wind, solar and hydro energy. For example, I assisted clients in forming the special corporation in order to construct, sell the output, operate and manage a 15MW wind turbine development in Massachusetts. I have represented clients in the issuance of over 4 billion dollars in securities, notes, letters of credit, lines of credit, bond issuances and loans.

In the Courtroom

I have tried over 100 utility rate cases in more than 25 different state and federal jurisdictions including the Federal Energy Regulatory Commission.  In the courts, I have represented clients on matters involving, breach of contract, employment, corporate structure, securities fraud, environment, bankruptcy, real estate, eminent domain, pension, professional licensure, property tax, negligence, wrongful death and construction.

I have appeared in cases before the United States Supreme Court; the United States District Courts for the Districts of Massachusetts, Maine, New Hampshire and Vermont; United States Circuit Courts of Appeal for the First and Second Circuits; the United States Bankruptcy Courts in Maine, New Hampshire and Massachusetts; the state Supreme Courts in Massachusetts, Maine, New Hampshire, Vermont and Rhode Island and I have appeared before trial courts and regulatory agencies in all of the New England states and in federal agencies, such as the United States Nuclear Regulatory Commission.

In the Statehouse

I have advised clients, drafted legislation and assisted in its passage in Massachusetts and New Hampshire.

Prior to founding Ferriter Scobbo, I was a solo practitioner in Boston. Before that, I worked with the National Consumer Law Center and in the Utility and Insurance Section of the Massachusetts Attorney General’s Office. There, I oversaw all financial, accounting and other business-related activity in all cases brought before the Massachusetts Department of Public Utilities and the Commissioner of Insurance.

I have three grown children and four young grandchildren. My wife and I enjoy spending time with all of them and our extended family and friends.   I enjoy my guitar and music. I have a love of golf, baseball, and for college sports, particularly, Boston College sports.
