Ferriter Scobbo & Rodophele, PC, represented the Massachusetts Municipal Wholesale Electric Company (“MMWEC”) before the New Hampshire Decommissioning Financing Committee (“Committee”), in the Committee’s proceeding to establish the funding requirements for each owner of the Seabrook Station Nuclear Power Plant (“Seabrook Station”), located in
The Committee’s mandate is to ensure that sufficient funds are available to properly and safely decommission the Seabrook Station site, following the expiration of Seabrook Station’s Nuclear Regulatory Commission license to operate. The Committee is required to determine the projected cost of decommissioning Seabrook Station, and the schedule of payments establishing how much each joint owner must contribute to the Decommissioning Fund each year. Funds held in the Decommissioning Fund are invested by the joint owners, subject to guidelines promulgated by the New Hampshire State Treasurer. The Committee compares the Decommissioning Fund balances and projected Decommissioning Fund balances to the projected cost to decommissioning Seabrook Station, to arrive at the annual schedule of payments for each joint owner. In order to carry out its mandate, the Committee solicits information and testimony from the joint owners and the public.
