Ferriter Scobbo & Rodophele, PC Successfully Represents Client before The Massachusetts Energy Facilities Siting Board

Ferriter Scobbo & Rodophele, PC successfully represented the Massachusetts Municipal Wholesale Electric Company (“MMWEC”) before The Massachusetts Energy Facilities Siting Board (“EFSB”) in obtaining approval for a new, dual-fuel, fossil-fired 280-megawatt power plant at MMWEC’s Stony Brook Energy Center in Ludlow, Massachusetts.  On December 12, 2008 the EFSB approved the construction and operation of the new facility, subject to certain conditions.  The approval paves the way for the construction of the Stony Brook 3 power plant scheduled for operation in 2013.  .

The EFSB reviews all proposals to construct energy facilities in Massachusetts.

The EFSB process involves a detailed review and evaluation of environmental impacts including air quality, land use, water, wetland, visual, noise, traffic, and safety impacts.  Once the extensive discovery process is completed, the EFSB staff conducts evidentiary hearings with the objective of determining if the project will provide a reliable supply of energy for the Commonwealth with a minimum impact on the environment at the lowest possible cost.  Once the evidentiary process is complete the EFSB itself engages in an energy policy application review of the issues addressed during the hearing process. 

Ferriter Scobbo attorneys, Nick Scobbo, Ann Ryan-Small and Bruce Anderson, assisted the client in the approval process with the preparation and oversight of the siting petition, written testimony of seven witnesses, responding to all discovery, three days of evidentiary hearings, and briefing and drafting the tentative decision.  There were approximately 200 exhibits entered in the evidentiary record.
