Ferriter Scobbo & Rodophele, PC Successfully Represents the Groton Electric Light Department before the Supreme Judicial Court

Ferriter Scobbo & Rodophele, PC successfully represented the Groton Electric Light Department (GELD) before the Commonwealth of Massachusetts Supreme Judicial Court.  The case involved the question of whether the Housing Appeals Committee (HAC) in the Massachusetts Department of Housing and Community Development had the statutory authority to order the taking of property to enable the construction, by a developer, of an affordable housing project. 

The case presented a question of law that was both novel and of such public interest that the Supreme Judicial Court granted the GELD’s Application for Direct Appellate Review. 

The case began when the HAC ordered the GELD to convey several easements on its property to a developer so that the developer could build an affordable housing project on adjacent property.  On behalf of the GELD, Nick Scobbo argued that the HAC did not have the statutory authority to order the GELD to convey the easements.  Ann Ryan-Small and Sherry Vaughn assisted in writing the briefs.

The Supreme Judicial Court agreed with GELD’s argument, holding that the HAC had exceeded its powers in ordering the GELD to convey the easements to the developer.
