Power Contract Case Argued before Massachusetts Appeals Court

   On June 19, 2008, Robert M. Granger, a shareholder in the firm, appeared before the Massachusetts Appeals Court for oral argument in a case arising from a long term purchase power agreement (“PPA”) between MASSPOWER, the owner of an electric generating facility in Springfield, Massachusetts, and the Massachusetts Municipal Wholesale Electric Company (“MMWEC”), a political subdivision of the Commonwealth of Massachusetts.    After MMWEC terminated the PPA for material breach, MASSPOWER sued MMWEC claiming that MMWEC’s termination was unlawful.  The Superior Court granted summary judgment in favor of MMWEC and dismissed the lawsuit.  MASSPOWER then appealed the Superior Court’s decision to the Appeals Court.
